1. Acceptance of Terms

By accessing or using Driving Roads ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Driving Roads provides route planning and discovery services for driving enthusiasts. Our service analyzes road data to suggest scenic driving routes based on factors like road curvature, elevation changes, and user preferences.

3. User Accounts

To access certain features, you must create an account using your phone number. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Scrape, crawl, or collect data from the Service without permission
• Use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce
• Share your account with others or create multiple accounts
• Reverse engineer or attempt to extract source code from the Service

5. Premium Subscription

Driving Roads offers optional Premium subscriptions with additional features.

Billing

Premium subscriptions are billed on a recurring basis (monthly or annually). By subscribing, you authorize us to charge your payment method automatically.

Free Trial

We may offer a free trial period. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods.

Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days notice before any price increase takes effect.

6. Driving Safety Disclaimer

You acknowledge and agree that:

• Road conditions change and may differ from our data
• You must always obey local traffic laws and speed limits
• You should check current road conditions before driving
• Weather, construction, or other factors may affect road safety
• Some roads may not be suitable for all vehicles or skill levels
• We do not guarantee the accuracy or safety of any route

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Driving Roads and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

Route data you create remains yours, but by using the Service, you grant us a license to use anonymized route data to improve our algorithms and services.

8. Third-Party Services

Our Service uses third-party services including:

• Google Maps Platform (subject to Google's Terms of Service)
• Payment processors (for Premium subscriptions)
• SMS providers (for authentication)

Your use of these services is subject to their respective terms and privacy policies.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVING ROADS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or property damage
• Any damages arising from your use of the Service
• Inaccurate route information or road conditions

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Route data will be accurate or up-to-date
• Defects will be corrected
• The Service is free of viruses or harmful components

11. Indemnification

You agree to indemnify and hold harmless Driving Roads, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any driving-related incidents

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes when possible.

13. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.
